Prescription Fraud Attorney in Phoenix
Understand Phoenix Prescription Fraud Charges & Your Defense Options
Arizona treats obtaining prescription medication by fraud differently from obtaining a dangerous drug by fraud. That distinction can substantially change the classification of the charge. Faussette & Faussette, PLLC represents Phoenix clients accused of conduct involving fraudulent prescriptions, alleged doctor shopping, misrepresentation, or other methods of unlawfully obtaining medication.
Our attorneys bring more than 30 years of combined legal experience to criminal defense matters. We listen carefully to your account before developing a customized strategy, then explain the charge, your legal options, and the path ahead in clear terms. This guidance allows you to make informed decisions without interpreting complicated statutes on your own.

Prescription Fraud Charges & Penalties in Phoenix
Charge classification depends on the drug category and alleged conduct. Obtaining a prescription-only drug by fraud under ARS 13-3406 is a Class 1 misdemeanor. Possessing such a drug for sale or unlawfully transporting, importing, selling, or transferring it’s a Class 6 felony.
ARS 13-3407 assigns more serious felony classifications to dangerous drug allegations. Obtaining or procuring the administration of a dangerous drug through fraud, deceit, misrepresentation, or subterfuge is a Class 3 felony. Simple possession or use of a dangerous drug is a Class 4 felony.
A conviction under ARS 13-3407 also requires a fine of at least $1,000 or three times the value of the dangerous drugs involved, whichever is greater. Arizona drug penalties can vary with the substance’s classification, quantity, and circumstances of the arrest, so the statutory label is only part of the analysis.
Consequences Beyond the Criminal Sentence
A felony drug conviction can affect voting rights, employment opportunities, and access to housing. For non-citizens, it can also create immigration consequences. As prescription fraud lawyers serving Phoenix, we review both the immediate criminal charge and the broader issues that may affect your decisions.

"Thank you, Jacob. I appreciate you so much."
Jacob represented me while I was in custody and I was doing very bad at that time in my life. I just wanted to thank him for everything he did for me. I was a mess during that time in my life and because he helped give me a second (third actually) chance I got my life together. I went to rehab and am complying with my probation and am now working towards getting certified as a behavioral tech so I can help others that need the help I needed. Thank you, Jacob. I appreciate you so much.
